According to article 206 item II of the Federal Constitution , teaching will be provided based on the following principles:
"II - freedom to learn, teach, research and disseminate thought, art and knowledge;"
According toTECHNICAL NOTE No. 392/2013 of MEC - Ministry of Education , on its page 5/6 such activity is described as follows:
" Open courses are those offered by entities that are not accredited by the Federal Education System for higher education undergraduate or graduate students...
being allowed to issue certificates of participation...
for this reason this Ministry of Education is not competent to act in the sense of inspecting, applying penalties... .l
non-educational entities that do not offer higher education courses and that only offer free courses."
Free schools are also recognized and admitted by the Federal Revenue of Brazil, within the framework of the Simples Nacional, below the transcript of Consultation Solution No. 387 of November 6, 2007:
"SUMMARY: SIMPLES NACIONAL. FREE EDUCATION AND TECHNICAL COURSE. Free education is the unregulated.
That is, in contrast to the regular education system,
they are courses of varying duration,
for professional activities or mere personal improvement, e.g.,
self help, beauty, fashion, behavior, reiki, feng shui etc.
The technical course is a kind of professional education genre, which leads to the development of skills for productive life,
in conjunction with regular education or through different continuing education strategies , in specialized institutions or in the work environment, through regular or special courses If the consultant's classes are taught in a free school or technical course, the Simples Nacional option is allowed, otherwise it is prohibited, as they are an instructor service and/or intellectual activity,of technical or scientific nature."
